Terms and Conditions for Waste Clearance Bow Services

These Terms and Conditions govern the provision of waste clearance and rubbish removal services by Waste Clearance Bow. By booking a collection, arranging a quotation or allowing our team to access your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection or related service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation requesting waste clearance or related services from Waste Clearance Bow.

Company, we, us or our means Waste Clearance Bow, the provider of waste collection and related services.

Services means any waste removal, rubbish collection, clearance, loading, transportation, disposal, recycling or related work carried out by the Company for the Customer.

Site or Premises means the property or location where the Services are to be carried out.

Waste means any materials, items, rubbish, junk or refuse that the Customer asks the Company to collect and remove.

2. Scope of Services

The Company provides waste collection and clearance services, including but not limited to domestic rubbish removal, commercial waste clearance, garden waste removal, bulky item collection and general junk removal. All Services are carried out in accordance with applicable UK waste regulations and environmental legislation.

The exact scope of Services, including what items are to be collected, the type of waste, access arrangements and any special requirements, will be agreed with the Customer at the time of booking or during an on-site assessment.

The Company reserves the right to decline the removal of any waste that is prohibited, hazardous, unsafe to handle or not suitable for transport under applicable regulations.

3. Booking Process

3.1 Enquiries and quotations

Customers may request a quotation or make a booking by telephone or email. To provide an indicative price, the Company may ask for information such as the type and approximate volume of waste, photographs of the items to be collected and details of access to the Premises.

Any quotation given prior to attending the Premises is an estimate only and is not binding. Final pricing is subject to confirmation once the Company has inspected the waste and assessed access and loading conditions on site.

3.2 Confirming a booking

A booking is confirmed when the Customer accepts the Companys quotation and a collection time and date are agreed. The Company may at its sole discretion require a deposit or pre-authorisation of payment details to secure the booking.

3.3 Changes to bookings

Any changes to the booking, including changes to the date, time, address, type or volume of waste, must be communicated to the Company as early as possible. The Company will use reasonable efforts to accommodate changes but cannot guarantee availability or that the same price will apply. Additional charges may be incurred where the scope of work increases.

4. Access and Customer Responsibilities

The Customer is responsible for ensuring that the Company has safe, reasonable and lawful access to the Premises on the agreed date and time. This includes but is not limited to:

Providing accurate address and contact information.

Ensuring that access routes, driveways, stairways and communal areas are clear and safe for our team and vehicle, where relevant.

Obtaining any necessary permissions or permits for access, parking or entry to the Premises.

Ensuring that any waste to be collected is clearly identified and separated where necessary.

The Customer must be present at the Premises for the duration of the collection unless otherwise agreed. If the Customer requests collection in their absence, they must provide clear instructions and accept that the Companys assessment of the Waste and the applicable charges will be final.

5. Pricing and Payments

5.1 Pricing

Prices for our waste collection and clearance services are generally based on factors such as the volume and type of waste, loading time, labour requirements, access conditions and any applicable disposal or recycling charges. Our pricing structure may be provided as a guide, but the final charge will be confirmed on site once the Waste has been inspected.

Where the amount or type of Waste differs from that originally described by the Customer, the Company reserves the right to adjust the price accordingly. If the Customer does not accept the revised price, the Company may cancel the job and charge a reasonable call-out or attendance fee.

5.2 Payment methods

Payment is due in full upon completion of the Services, unless otherwise agreed in writing. The Company accepts standard UK payment methods, which may include cash, debit card, credit card or bank transfer, subject to change at our discretion. Any applicable VAT will be added to the price where required by law.

5.3 Late payments

If payment is not made when due, the Company reserves the right to charge interest on outstanding amounts at the statutory rate and to recover any reasonable costs incurred in pursuing payment, including legal costs and recovery charges.

6. Cancellations and Rescheduling

6.1 Customer cancellations

The Customer may cancel or reschedule a booking by contacting the Company. To avoid cancellation charges, the Customer should provide as much notice as possible and, in any event, not less than 24 hours before the scheduled collection time, unless otherwise specified by the Company.

Where a booking is cancelled on the day of the scheduled collection or where our team attends the Premises and cannot complete the job due to circumstances within the Customers control, the Company may charge a cancellation or attendance fee to cover costs incurred.

6.2 Company cancellations

The Company reserves the right to cancel or reschedule any booking in the event of operational issues, vehicle breakdown, staff illness, extreme weather, unsafe conditions or other circumstances beyond our reasonable control. In such cases, we will notify the Customer as soon as reasonably practicable and offer an alternative appointment. The Company is not liable for any loss arising from such cancellation or rescheduling, but any deposit taken for the affected booking will be refunded if the Customer does not accept an alternative appointment.

7. Waste Types and Prohibited Items

The Company will collect most general household, commercial and garden waste. However, certain items are prohibited or require special handling and may not be accepted as part of standard Services. These may include, without limitation, asbestos, clinical or medical waste, chemicals, oils, fuels, gas cylinders, explosives, radioactive materials and other hazardous substances as defined by UK law.

The Customer must inform the Company in advance of any potentially hazardous or unusual materials. If such items are discovered during collection and were not previously declared, the Company may refuse to remove them and may adjust the price or terminate the Service at its discretion.

Where the Company agrees to handle waste that requires special treatment, additional charges may apply and further terms may need to be agreed in writing.

8. Service Performance and Timeframes

The Company will use reasonable care and skill in providing the Services and will make reasonable efforts to attend the Premises at the agreed time. Any collection time provided is an estimate only and may be subject to delays due to traffic, weather, operational constraints or other factors beyond our control.

The Customer acknowledges that time is not of the essence in relation to the performance of the Services. The Company is not liable for any indirect or consequential losses arising from delays, provided that we perform the Services within a reasonable time.

9. Liability and Damage

9.1 General liability

The Company will take reasonable care when carrying out the Services. However, the Customer is responsible for protecting floor coverings, decorations, fixtures and fittings that may be vulnerable during the removal process. The Company will not be liable for minor cosmetic damage or wear and tear that results from normal waste removal activities.

Nothing in these Terms and Conditions excludes or limits the Companys liability for death or personal injury caused by our negligence, for fraud or for any other liability that cannot be excluded under UK law.

9.2 Indirect and consequential loss

The Company is not liable for any indirect, consequential or economic loss, including but not limited to loss of profits, loss of business, loss of opportunity or loss of data, arising out of or in connection with the provision of the Services, whether in contract, tort or otherwise.

9.3 Limitation of liability

Subject to the above, the Companys total liability to the Customer for any loss or damage arising out of or in connection with the Services shall not exceed the total price paid or payable for the specific job giving rise to the claim.

10. Customer Warranties and Indemnity

The Customer warrants that they are the owner of the Waste or are otherwise authorised to arrange its removal. The Customer further warrants that the Waste does not contain any prohibited items or materials that the Company has not agreed in writing to handle.

The Customer shall indemnify and keep the Company indemnified against any claims, liabilities, damages, penalties, costs or expenses arising from a breach of these warranties, including but not limited to any claims by third parties or regulatory authorities relating to ownership or nature of the Waste.

11. Compliance with Waste Regulations

The Company operates in accordance with applicable UK waste management and environmental regulations. All Waste collected is transported and disposed of or recycled at authorised facilities. Where required, the Company will complete appropriate documentation for the transfer of Waste.

The Customer acknowledges that once the Waste has been collected and accepted by the Company, responsibility for its lawful transport, treatment and disposal passes to the Company. However, if the Customer has misdescribed the Waste or concealed prohibited materials, the Customer may remain liable for any breach of law or additional costs incurred by the Company in dealing with such materials.

12. Intellectual Property and Content

Any photographs, descriptions, pricing information, logos, branding or other content provided by the Company in relation to its waste collection and clearance services remain the intellectual property of the Company. They may not be reproduced, copied or used for any other purpose without our prior written consent.

13. Data Protection and Privacy

The Company collects and processes personal data such as names, contact details, addresses and payment information for the purpose of providing the Services, managing bookings, processing payments and complying with legal obligations. The Company will handle such data in accordance with applicable UK data protection laws.

The Customer consents to the Company using their contact details to communicate about current or future bookings, service updates and necessary administrative matters. The Customer may request access to or correction of the personal data held by the Company, subject to legal requirements.

14. Force Majeure

The Company shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, but are not limited to, extreme weather, fire, flood, acts of God, strikes, labour disputes, pandemic events, transport disruptions or the actions of third parties.

15. Variations to Terms

The Company reserves the right to update or vary these Terms and Conditions from time to time. Any changes will apply to bookings made after the updated Terms and Conditions have been made available. For ongoing or long-term arrangements, the Company will notify the Customer of any material changes that may affect the Services.

16. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.
